1. Legal Binding Agreement and Acceptance

This Universal Privacy Policy (the "Policy") constitutes a legally binding agreement between 999Antiques, LLC (hereinafter referred to as "999Antiques", "Company", "we", "us", or "our") and you, whether personally or on behalf of a business entity (hereinafter referred to as "User", "Member", "Applicant", or "you").

This Policy governs your access to and use of the 999Antiques ecosystem, including but not limited to:

  • The Public Portals: 999antiques.com, exclusive.999antiques.com, apply.999antiques.com, join.999antiques.com
  • The B2B Trading Platform: club.999antiques.com
  • Encrypted Alpha-Channels: Private networking groups managed via third-party messaging services (WhatsApp and Telegram).

BY SUBMITTING AN APPLICATION, REGISTERING AN ACCOUNT, OR ACCESSING ANY PART OF THE ECOSYSTEM, YOU EXPLICITLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE ENTIRETY OF THIS POLICY. If you do not agree with any provision of this Policy, you must immediately cease all access to the sites and services.

2. The "Intermediary Only" Doctrine and Service Nature

999Antiques operates exclusively as a High-Security Digital Facilitator and a B2B Bulletin Board Infrastructure.

2.1. Passive Technological Infrastructure

999Antiques provides the digital venue for verified professional networking and asset listing. We are not an auctioneer, a broker, a licensed appraiser, or a party to any contract. We do not act as an agent for any of the transacting Antique Dealers or professionals.

2.2. Financial Neutrality & No Payment Involvement

999Antiques is NOT a financial institution, escrow service, or money transmitter. We do not process, facilitate, hold, or guarantee the exchange of funds between Users for any antiquities or assets. All financial negotiations, purchase payments, and settlements are conducted independently of the Ecosystem.

2.3. Logistical & Custodial Disclaimer

999Antiques never takes physical possession, custody, or control of any antiquities or assets described or listed within the Ecosystem. We do not provide shipping, insurance, or storage services for assets. The physical inspection, verification of authenticity, and secure delivery of goods are the sole responsibility of the transacting Users.

2.4. Informational Purpose Only

Any "Expert Consensus," estimated valuations, or market data provided within the Private Club or Alpha-Channels are for informational and educational purposes only. They do not constitute a formal appraisal or a guarantee of value. Users must rely on their own professional expertise before committing to any transaction.

3. Categories of Data Collected and Processing Protocols

To maintain the security and exclusivity of the Ecosystem, 999Antiques collects and processes specific categories of information.

3.1. Professional Antique Dealer & Business Data (B2B)

For individuals and entities applying for access to the Private Club and Alpha-Channels, we collect "Know Your Business" (KYB) identifiers, including but not limited to:

  • Authorized Representative Information: Full legal name, professional title, direct business email, and primary telephone number.
  • Business Credentials: Legal registered name of the business entity, physical business address (residential addresses or P.O. Boxes are strictly prohibited), and official website or professional digital listings.
  • Regulatory & Licensing Assets: High-resolution digital scans or photographs of an active Antique Dealer License or equivalent credentials, local operating permits, or official professional association certificates.
  • Verification Identifiers: Government-issued identification (Passport, Driver's License) of the business owner or authorized representative for manual identity cross-referencing.
  • Social Connectivity Handles: Telegram and WhatsApp handles/numbers required for integration into the encrypted Alpha-Channels.

3.2. Retail Customer & Asset Data (B2C)

For items submitted through our public portals or integrated networks for liquidation, trading, or distribution to the B2B network, we collect:

  • Lead Information: Full name, contact details (email/phone), and general geographic location of the submitting party.
  • Asset Intelligence: Detailed high-resolution imagery of the antiquities and assets, descriptions of the item's condition, provenance documentation, and any provided digital copies of certificates of authenticity, expert opinions, or historical records.

3.3. Technical and Metadata Collection

For security, fraud prevention, and system optimization, our servers automatically collect:

  • Device Fingerprinting: IP addresses, browser types, operating systems, and unique device identifiers.
  • Geolocation Data: General location data to ensure compliance with regional trading laws and international cultural property regulations.
  • Image Metadata: We reserve the right to analyze EXIF metadata on uploaded images for verification, though we purge this data before any internal B2B distribution to protect User privacy.

3.4. Financial Transaction Metadata

While we do not handle transaction funds between users, we collect billing information through our Third-Party Payment Processor for the purpose of managing the $99.99/month subscription. This includes billing addresses and truncated card information (e.g., last 4 digits) for record-keeping purposes.

4. Verification Workflow, Subscription, and Account Security

4.1. The Manual Review Process (Audit Phase)

Every application submitted undergoes a comprehensive manual audit by our Compliance Department. 999Antiques reserves the absolute right to contact local issuing authorities or professional associations to verify the validity of licenses and credentials, request additional documentation or live identity verification (Video KYC), and reject any application at our sole discretion without providing a specific justification.

4.2. Subscription Activation & Recurring Billing

  • Membership Fee: Access to the Private Club and Alpha-Channels is subject to a recurring monthly fee of $99.99.
  • Automatic Renewal: By providing payment details to our Third-Party Payment Processor, you authorize the Company to charge the subscription fee automatically every thirty (30) days.
  • Non-Refundability: Due to the manual labor involved in the audit process and the immediate access granted to proprietary B2B data, all payments are strictly non-refundable.

4.3. Issuance of Access Credentials

Once payment is confirmed, 999Antiques generates and issues Temporary Access Credentials (Username and Temporary Password) to the User for access to club.999antiques.com.

4.4. Mandatory Password Reset & Security Responsibility

  • Mandatory Action: Upon the first successful login, the User is strictly required to change the temporary password to a unique, high-complexity password known only to the User.
  • Liability for Compromise: 999Antiques shall not be held liable for any unauthorized access, data breaches, or financial losses resulting from the User's failure to change the temporary password or for the use of weak or shared credentials.
  • Credential Sharing Prohibited: Access is granted to the individual or business entity verified. Sharing login credentials with unauthorized third parties will result in immediate termination of access without a refund.

4.5. Access Monitoring and Session Security

To prevent "Account Takeover" (ATO) and unauthorized entry, we implement continuous monitoring of login patterns, IP addresses, and device fingerprints. We reserve the right to lock any account that demonstrates suspicious or geographically inconsistent access patterns.

5. Data Retention, Perpetual Registry, and User Accountability

5.1. The Professional Integrity Ledger

To maintain the security and exclusivity of the Private Club, 999Antiques maintains a long-term data retention policy for all professional members. Business verification data, including license copies and identity documents, are retained as part of a permanent "Professional Integrity Ledger." This is essential to prevent the re-entry of bad actors and to provide a verified audit trail for any past transactions conducted within the Ecosystem.

While users may request account deactivation, 999Antiques reserves the right to retain core verification data in an encrypted, offline state to satisfy Anti-Money Laundering (AML) standards, internal security protocols, and to assist in potential legal or regulatory inquiries.

5.2. Strict Individual Legal Accountability

999Antiques provides the digital infrastructure, but the User carries 100% of the legal, criminal, and financial burden for their conduct. Any User who lists, discusses, or trades assets — including stolen property, looted cultural heritage, counterfeit items, or assets with unverified provenance or legal liens — does so in direct violation of this Policy and at their own legal peril.

999Antiques reserves the right to disclose any retained data, including IP logs and verification documents, to law enforcement and regulatory agencies (such as INTERPOL, the FBI, FinCEN, or local authorities) without prior notice to the User, if we have a good-faith belief that such disclosure is necessary to comply with a legal process or investigation.

5.3. No Warranty of Professional Integrity

The "Verified Member" status indicates only that 999Antiques performed a Manual Review of the professional license or equivalent credentials at the time of application. It does not constitute a recommendation, endorsement, or guarantee of a Member's business ethics, financial solvency, or expertise. Users are strictly required to perform their own independent due diligence before committing to any trade or financial exchange with other members.

5.4. Indemnification

By using the Ecosystem, you agree to indemnify, defend, and hold 999Antiques, LLC harmless from any third-party claims, lawsuits, or government fines resulting from your actions, your misrepresentations during the verification process, or your failure to comply with international and local trade, export, and cultural property laws.

6. Alpha-Channels and Third-Party Networking Risks

6.1. Third-Party Platform Dependency

By joining Alpha-Channels, you acknowledge that these services are owned and operated by third parties (Meta Platforms, Inc. and Telegram FZ-LLC). You are subject to the respective Privacy Policies and Terms of Service of those platforms. 999Antiques is not responsible for the underlying encryption, data storage protocols, or potential security vulnerabilities of WhatsApp or Telegram.

6.2. Disclosure of Contact Information

Entry into an Alpha-Channel inherently involves the visibility of your professional contact identifiers (phone number, profile name, and handle) to other verified members within that group. By requesting entry into these channels, you grant 999Antiques permission to add your contact details to these groups. 999Antiques is not liable for any unsolicited communication or "side-deals" initiated by other members using information obtained within the Alpha-Channels.

6.3. User Conduct and Information Leakage

Information shared within Alpha-Channels is intended for the exclusive use of verified members. However, 999Antiques cannot technically prevent, and is not liable for, any member taking screenshots, copying data, or leaking proprietary information to outside parties. 999Antiques does not act as a moderator, arbitrator, or judge in disputes arising from interactions within Alpha-Channels and is not liable for the accuracy of "Expert Consensus" or any financial losses resulting from group discussions.

6.4. Right to Termination

999Antiques reserves the absolute right to remove any member from Alpha-Channels at its sole discretion, without prior notice, for conduct deemed detrimental to the community. Such removal does not entitle the member to a refund of their subscription fee.

7. Service Availability, Technical Limitations, and Force Majeure

7.1. "As-Is" and "As-Available" Warranty Disclaimer

999Antiques provides its entire digital infrastructure strictly on an "as-is" basis. We expressly disclaim all warranties, whether express or implied. We do not guarantee that the service will be uninterrupted, secure, or free from viruses or technical errors.

7.2. Comprehensive Limitation of Liability for Outages

Under no circumstances shall 999Antiques, LLC, its owners, or employees be held liable for any financial losses, "lost deals," loss of anticipated profits, or business interruptions resulting from:

  • System Downtime: Planned or unplanned server maintenance, hosting failures, or software glitches.
  • Third-Party Disruptions: The sudden suspension, termination, or change in Terms of Service by external providers (e.g., WhatsApp, Telegram, or our Payment Processors).
  • Cybersecurity Events: Criminal acts such as DDoS attacks, hacking, or unauthorized database entry, provided that 999Antiques has maintained reasonable industry-standard encrypted cloud storage protocols.

7.3. Force Majeure

999Antiques shall not be responsible for any failure to perform its obligations if such failure is caused by events beyond its reasonable control. This includes, but is not limited to: natural disasters, war, civil unrest, government-mandated internet shutdowns or censorship, global pandemics, or catastrophic failures of national power grids or telecommunications networks.

7.4. Modification and Discontinuation

999Antiques reserves the right, at its sole discretion, to modify, relocate, or discontinue any feature of the Ecosystem at any time without prior notice or liability.

8. Asset Imagery and Data Rights

8.1. License to User-Generated Content

By uploading photographs, descriptions, provenance records, or certificates of antiquities and assets to the Ecosystem, you grant 999Antiques a non-exclusive, royalty-free right to use, analyze, and display this content for the purposes of: facilitating B2B trades and trade inquiry distribution; developing internal market analytics and "Expert Consensus" databases; and improving platform security and fraud detection algorithms.

8.2. Metadata and Privacy Scrubbing

999Antiques implements automated protocols to remove EXIF metadata (such as GPS coordinates and device info) from uploaded images before they are shared within the B2B network. However, we are not responsible for metadata contained within images shared directly by users via WhatsApp or Telegram Alpha-Channels.

9. Regulatory Compliance, Jurisdiction, and Amendments

9.1. Global Privacy Standards

  • CCPA (California Privacy Rights Act): We do not "sell" your personal or business data to third-party marketing brokers for profit. Data sharing is strictly limited to the internal B2B network for the purpose of facilitating the transactions you initiate.
  • GDPR (European Union): For Users in the EEA, our data processing is based on Contractual Necessity (to provide the requested Club services) and Legitimate Interest (to ensure the security and integrity of the luxury asset market).

9.2. "Do Not Sell My Information" Request

Under the CCPA, you have the right to opt-out of the "sale" of your personal data. Note: exercising an opt-out for data sharing within the B2B network will result in the immediate termination of access to the Private Club and Alpha-Channels.

9.3. Governing Law and Jurisdiction

This Policy and all matters arising from your use of the Ecosystem shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Florida.

9.4. Severability

If any provision of this Policy is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9.5. Modifications to this Policy

999Antiques reserves the right to update or revise this Policy at any time. The "Effective Date" at the top of this document will reflect the latest version. Your continued use of the Ecosystem after any changes are posted constitutes your acceptance of the revised Policy.
